Now that Father's Day has passed and the decision by the U.S. Supreme Court on the Second Amendment is imminent ....

    …. in the next few weeks, I thought this would be an eye-opener during the election season.  You can thank U.S. Senator Frank Lautenberg for the destruction of this man's life and career as a medical professional.

U.S. Senator Frank Lautenberg (Democrat-- New Jersey) is the former owner of Automatic Data Processing (ADP) which is one of the largest payroll companies in the United States.  Lautenberg sold ADP prior to getting into politics.  He made millions on the sale and his annual retirement salary is at least One Million Dollars per year.  Senator Lautenberg has become one of the worst leftist politicians in Congress and has become part of the "good ole boy" "One-Worlder" network in Washington, D.C. 

Lautenberg claims he doesn't cater to special interests but the National Organization of Women (NOW) and the Sierra Club come to mind immediately.   With regard to the Sierra Club, Lautenberg (or as some say "Lousenberg") has been instrumental in prohibiting the drilling and exploration of oil within the United States (ANWAR) and drilling off of the U.S. coasts.  Yet, he allows countries like China and Cuba to drill 50 miles off of our coasts while prohibiting our own oil companies from doing so.  And, he prohibits drilling in Alaska (ANWAR), while right across the border in the Yukon and Northwest Territories of Canada, the Canadians are exploring and drilling for oil and then selling it to the United States.  It doesn't seem that the caribou mind the Canadians drilling for oil on the same lands as Lautenberg and rest of the Marxist Congress prohibit American oil companies from seeking the huge oil reserves there and protecting our national security interests. 

Lautenberg has done more damage to the American economy and American family than most of the Washington accolytes.  Lautenberg may be have been a good businessman at one time, but he has been infected with the Marxist virulence that permeates the government at this time. 

Interestingly, Lautenberg, being Jewish, should know better.  His own people bore the brunt of near-extermination by nationalist socialists--the most radical of left wing socialists.  Lautenberg forgets wence he comes.  He is now doing to the rest of America, what the Nazis did to the Jews and "undesirables" in the 1930s and 1940s.  The current "undesirables" are now you and me--the American middle-class taxpayer that makes this country run.  Lautenberg lives in his ivory tower and has no compassion or knowledge of what us serfs have to endure because of his anti-American legislation that he contrives to cater to his special interest friends;  not his real constituents--the American taxpayers and voters.

Lautenberg has been most anti-American when it comes to families and Second Amendment Rights.  Lautenberg obviously forgets he took an oath of office to uphold, support and defend the United States Constitution when he became a government servant.  By ignoring his oath, Lautenberg has committed official misconduct and treason against the U.S. Constitution.  The penalty for treason is either long-term imprisonment or execution by firing squad.

Now, I get to the story at hand:  

As we wait for the U.S. Supreme Court to rule in the District of Columbia v. Heller case, giving us their interpretation of the Second Amendment  it is timely to review Dr. Timothy Emerson's case, United States v. Emerson, 270 F.3d 203 (5th Cir. 2001), that first led federal courts to rule that the Second Amendment is an individual rather than a collective right.   

The sordid story begins in 1998. As is so common with domestic violence cases, according to court records Emerson's then-wife, Sacha, was having an affair with her hairdresser. At the time Emerson had a private medical practice in San Angelo, Texas.  Sacha petitioned for divorce on August 28, 1998, and got a restraining order against Emerson, claiming he had threatened her paramour. Emerson lawfully owned 30 types of firearms that he owned before and  during the marriage. He had a handgun that he kept in his office because doctors have many drugs in their offices.    

The restraining order made him immediately subject to Federal criminal statute 18 U.S.C. §922(g)(8), the infamous Lautenberg Amendment, that makes the possession of any firearm or ammunition while under a restraining order a federal felony with a mandatory prison term of up to ten years. No one informed Emerson, who mistakenly represented himself at the divorce hearing, that he would be subject to federal criminal prosecution while a restraining order was in effect. The Lautenberg Amendment was inserted into the Violence Against Women Act ("VAWA"), which is an abomination to the Constitution, and the name of the law implicates the government for automatic gender bias.  Lautenberg was pressured by the radical feminist special interest groups of NOW and the battered women's groups.  Lautenberg was instrumental in "back-dooring" the attempted elimination of our Second Amendment Rights through domestic violence laws. 

As an aside, domestic violence in this country has been shown to be a canard perpetrated by radical feminists with the aiding and abetting of compliant Congressmen and Congresswomen.   Over 200 empirical studies, periodicals, analyses, books and reports (see the megastudy by Dr. Martin Fiebert by Googling his name or Googling "battered mens' studies on the internet) have shown that domestic violence is committed equally by men and women, and that a majority of domestic violence cases are false.  Some experts and government statistics believe over 75% of all domestic violence cases to be false.

On November 16, 1998, Sacha barged into Emerson's office with their 4-year old daughter and refused to leave. After an argument in his office she contacted San Angelo police alleging Emerson had pulled the gun on her and the child.  As a result, charges of aggravated assault with a deadly weapon and endangering a child were brought against Emerson and he was arrested and jailed. His firearms collection was seized, and he was charged with a Federal felony. The arrest ended his medical career.   

Later, a Federal Grand Jury indicted Emerson on five counts under 18 U.S.C. § 922(g)(8). Surprisingly, the Federal judge granted Emerson's motion to dismiss the case, on grounds his Second and Fifth Amendment rights had been violated. This was the first time any Federal court had confirmed that the Second Amendment is an individual right. But the government, under Democrat President Clinton and Attorney General Janet Reno, appealed.  This is because the Democrat party is beholden to NOW and radical domestic violence women's coalitions.

Emerson was acquitted by a jury of all charges brought by the state after a showing that he was defending his business property and patient medical records against criminal trespass. This time he went to court with a competent attorney supported by the Second Amendment Foundation.  The Fifth Circuit Court of Appeals affirmed the Second Amendment as an individual right but remanded Emerson's case back to the lower court for trial, reversing dismissal  of the case. After the case went to the Supreme Court and was denied certiorari, the case was then set for trial in Federal District Court in Lubbock, Texas.  And those of you who thought double jeopardy was unconstitutional should rethink your position. 

A Federal jury of six men and six women found Emerson guilty of three counts of possessing firearms while under a restraining order.  The stress of this injustice had an extremely deleterious effect on Emerson's health causing him to have open-heart surgery.  He is still disabled and indigent as a result.  Because he has lost his medical practice and income, Texas has taken Emerson's medical and driver's license away for non-payment of child support. His heart condition prevents him from working. Taxpayers are obliged to pick up his medical and living expenses.  Citizens pay for his wife's adultery as well for the child support and alimony from the state welfare department.    Emerson was sentenced to thirty (30) months. Appeals were denied.

After parole, Emerson's father died, and Emerson was left homeless. His mother has been in a nursing home since 2006.  Emerson has been unlawfully denied the right to see his young daughter (another Constitutional violation of the parent-child relationship).  And, they are still hunting, or haunting, him for non-payment of child support.

Frank Lautenberg is no friend of the U.S. Constitution.  He is no friend of Americans.  If he was, he would've known that laws like the one he made above would destroy respected careers like Tim Emerson's.  While this country needs competent medical professionals, we have ignorant, anti-American, federal politicians destroying the medical profession, and destroying people's lives for special interests, power and control.  Lautenberg is drunk with power and it shows.  Emerson should sue Lautenberg directly for all his college and medical school tuition and expenses in opening and maintaining his medical practice until it was destroyed.  Emerson should seek damages for lost future income.   But, alas, Emerson has been made destitute by the same government we all believed in at one time.  He can no longer afford legal counsel to sue for interference with his economic advantage and lost future business opportunities.  The government of the United States is not a government at all, but a monolithic, all-powerful entity bent on destroying the American people for profit and gain.  And, it is being done by special interest driven representatives; not representatives of the People it is supposed to serve.

Lautenberg does not care about Americans or even Jews.  This 84-year old dinosaur relic wants another 6-year term in the U.S. Senate.  The man, if you can call him that, would destroy the rest of this country if allowed to remain in power and use his addled-thought process, which has bordered on senility and dementia for some time.   All he's interested in is maintaining power through special interest groups.  To hell with the voters and taxpayers that kill themselves to maintain this country, only to have the Lautenbergs of the world give it away to our enemies from outside and from within.  Lautenberg is a traitor to the Constitution and the American people and he should be turned out of office and tried for high crimes and treason.
