Rape is the outcome when Justice is denied. Clearly, Centre County Pa. prosecutor Lance T. Marshall is now and has been maliciously and so intentionally denying an innocent man, Austin Scott, the [PSU] Penn State football tailback Star, Justice. How? Easily, just by the suppression of evidence of Scott’s innocence.

Panic has self evidently attacked, the obscene “Persecutor” Lance T. Marshall, who this writer sees as a mere opportunist abusing the powers of his office. Marshall is the dubious “public servant” who yesterday on 15 April 2008 Tuesday must have scrambled his public official government office to file a flawed interlocutory, emergency appeal. The Notice Of Appeal filed by Marshall's office is intended to suppress evidence of a prior  false rape accusation by the defendant accuser Minder and it stated "....the aforesaid orders will terminate or substantially handicap the prosecution".

As a direct result Marshall has thus -- for now -- halted the beginning of the previously scheduled, Austin Scott, trial which had previously -- about ten days ago --been set for 16 April 2008, Wednesday. The trial would likely have concluded on Friday.

Next week, Austin Scott was to attend the NFL drafts for this year. Scott rated third in last weeks tryouts. Lance T. Marshall in the unanimous opinion of the National Writes Syndicate staff is merely out to destroy the great potential of Austin Scott’s life in order to elevate his own future career advances, from is his own tedious life. Nothing else, it seems logical, will explain Marshall’s feverish conduct throughout this entire matter. Here’s why!

The “emergency” interlocutory appeal now under way is based upon a Court Order issued by the trial Judge in the pending case benefiting Austin Scott.

The Honorable Judge, Thomas King Kistler, had determined that the factual Evidence -- contained in the Transcript of a previous rape trial -- which pointedly shows that the accuser in this case, now before Judge Kistler, shows that Ms. Desiree Minder has a history of making false rape accusations against men after she entices them to engage in sexual activity.

The National Writers Syndicate.com notes that: the Honorable Judge, Thomas King Kistler has followed the law in this instance without the usual unconstitutional activism of an “activist” gender biased judge. This must be the “rub” for Lance T. Marshall in this “Emergency Appeal” to stop the trial before it is to late for Marshall. Centre County Pa. prosecutor Lance T. Marshall is a disgrace to the Constitutional intent of the interests of equal justice.

Desiree Minder in fact at that time in 2003 lied under oath; this lie told while under her oath to tell the truth is also known criminally as perjury. Minder confessed to lying in court while she was on the “Stand,” and during her testimony in the last case in 2004. At that time it was the innocent Mr. Burgan against whom Desiree Minder lied.

Today Ladies and Gentlemen this is exactly what Desiree Minder is doing with the unwarranted help of Prosecutor Lance T. Marshall to the Innocent Mr. Austin Scott. The prosecutor in the Burgan case should have prosecuted Minder for perjury after this all became clear to everyone. Clearly the first prosecutor failed in his duty to the general public, just as Centre County Pa. prosecutor Lance T. Marshall is doing now, to protect the innocent.

Had that first prosecutor applied the “law” equally and prosecuted Minder for criminal perjury this current unjust and malicious prosecution against Mr. Austin Scott would not now be happening.

Desiree Minder must be removed from the streets as a public danger, but due to generic official government sponsored Gender Bias against men, Desiree Minder remains at large to strike again.

Well, we can’t have the jurors here in Centre County know those facts about Minder now, can we? That folks is the position of the Centre County Pa. prosecutor Lance T. Marshall in the Austin Scott case, today. Thus, the Prosecutors panic to prevent the jury from knowing all of the facts in the Scott case.

Essentially, Marshall’s position is that if that factual evidence of the previous Minder perjury is allowed to reach the jury, Centre County Pa. prosecutor Lance T. Marshall, has no viable case against Austin Scott.

Marshall knew that she, Desiree Minder, was in fact a real nut job who belongs in the nuthouse, all along. 

Yet, the soon to be disgraced prosecutor of Centre County Pennsylvania, Marshall, undertook the case based upon obvious false accusations, in order to personally benefit from the ongoing, pervasive sex discrimination and bias targeting men. If Austin Scott was not a famous and rising football star, this writer is convinced that Marshall would not have even considered taking the case.

Marshall should be disbarred, just as Nifong in the Duke Lacrosse case was, but much, much sooner than Nifong.

The argument in rape cases is that the scars left by the rape can never heal. However, sexual rape is overwhelmingly short term and does not result in the permanent loss of ones choice of their lifetime occupation.

Here at the National Writers Syndicate.com, we assert that the scars of a malicious prosecution -- as Marshall is conducting here -- which in fact will destroy a lifetime choice of ones occupation is ultimately more onerous and devastating.  Therefore, Marshall and Minder are the rapists and unequivocally, Austin Scott is the victim, not Desiree Minder.
